How to Avoid a Conservatorship

Before a person reaches the point where a Conservatorship might be needed, LA LAW Conservatorship/Elder Law attorneys may be able help you avoid this court action by creating an estate plan that includes the following documents:
• A legal document called a “Durable Power of Attorney” will allow you to assign a trusted person to handle your affairs for assets and other administrative needs should you become mentally or physically incapacitated.
• Without a proper Durable Power of Attorney, if you suffer a tragic illness or injury, leaving you incapable of managing your finances, your family will be forced to establish a Conservatorship though the court in order to assist you with your finances. This is expensive and very complicated and stressful for your family.
• Another important legal document, an “Advanced Health Care Directive” will allow you to designate someone to make medical decisions for you, as well as allowing you to leave instructions on your wishes for end of life decisions should it be needed when you are incapacitated. This is of great benefit not only to you but also to your family and loved ones as they will have a legal document that defines your wishes in clear legal language for the doctors or other medical staff.
Also, you may want to put in writing who you wish to be your conservator, if one is ever needed. This document is called a “Nomination of Conservator” and allows you now to say who you would want to be your conservator in the event that the court decides that a Conservatorship is necessary. This is especially important if you have a trusted friend that would have no particular standing in who can be your conservator. The court wants to provide the most logical conservator for your best interests. The Probate Code suggests a standing of Spouse, Children, Siblings, Nieces/Nephews, etc. If your significant other or simply a trusted friend is your choice to represent your interests in the event you can not, you must document this.
